EB5 Visa Requirements
An investment into a new or existing commercial enterprise, owned and operated by the individual investor is required. However, there are structures that allow investors to be a partner and do not require the individual investor to manage the daily tasks of the enterprise. As of March 15th, 2022, an investment of $1,050,000 (originally $1,000,000) into a business is required to obtain an EB5 visa, followed by the creation of employment for 10 or more full-time American employees.
*An investment of $800,000 is acceptable if the business is situated in a targeted employment area (TEA).
The Immigrant Investor Pilot Program (EB-5 Visa)
The second program—The Immigrant Investor Pilot Program—was created by Section 610 of Public Law 102-395 on October 6, 1992. The investment could only be received by an economic unit defined as a Regional Center. The Regional Investment Center program is ideal for the investor who does not wish to actively operate a business in the U.S. The investor has the option of two investment project types. These are the EB5 Regional center investments or EB5 direct Investment project.
